Paula Giannelli Paula is accredited by the Law Society as a specialist in Family Law. She did her traineeship with Blackadder & McMonagle solicitors in Falkirk. She joined Gair & Gibson solicitors, also in Falkirk, in 2007 and became a partner in 2010. She worked with Gair & Gibson specialising in Family Law until the middle of 2019 when she joined Nero Legal to start up their family department. She has been an accredited specialist in family law for over six years. Paula has extensive court experience both in the Sheriff Court and instructing Counsel for the Civil Appeal Court. Jamie Lee Speirs Jamie graduated from the University of Edinburgh accelerated Law degree program in 2018, having already completed an undergraduate History degree at the University of Victoria (Canada) in 2015. Jamie completed the Diploma in Professional Legal Practice at the University of Glasgow in 2019 and qualified as a Solicitor in June 2021. Jamie has experience in a range of Family Law matters including child contact, divorce, separation, cohabitation and prenuptial agreements as well as experience representing clients in the Sheriff Court. The breakdown of a relationship or marriage is a stressful and difficult process. You and your spouse/partner should try your utmost to sit down and talk things over prior to the separation. This may be very difficult, especially if you do not want the separation and are hurt and upset. In some circumstances it might be helpful to involve another family member such as a grandparent or sibling. This can help when dealing with emotions which are running high. You should note points down that you are able to agree upon.
Sound advice from an experienced family lawyer can be of untold value at the early stages of a separation. At Nero Legal we can give you that advice and can help you negotiate and draw up a ‘separation agreement’. With the help of our family law team, we can discuss with you the law which applies in relation to your separation, and if necessary we can negotiate with your spouse on your behalf. If it transpires that you cannot reach an amicable settlement and you feel your case will have to go to court then we can assist you with that but this is something that we will try to avoid if at all possible.

Many separating couples find it helpful to enter into a written separation agreement (known as a Minute of Agreement) with their spouse/ex-partner in relation to all the issues arising from the breakdown of their marriage/relationship.
A Separation Agreement is the equivalent of a ‘contract’ entered into by yourself and your spouse/partner. This can be registered with the Books of Council and Session. The terms of your Separation Agreement will depend on a number of factors. Every agreement is different and individual to each couple: do you want to sell the house, keep it in joint names, have it transferred to one of you, can you afford to buy the other party out, what is to happen with the mortgage, will the other party move out right away, will they rent a property, will you both live in the same house for a period of time, what about the children, who will they stay with, if they stay with mum when will they see dad and vice versa.... When you open the door on your first day in law you are never struck with the overriding charitable spirit of the environment. If you are from Mars, let me explain that law is a place of regulation, deadlines and pressure. Law was never the typical place to start, but then again law was not the start, the seeds that grew Nero started before a life in law. It was never going to be easy to dampen the life experiences of its founding members. From experiences grown from; social sciences; pharmacy and sports to young minds with a conviction to always consider the way it could be. Yet law was the meeting point, and law is now our business. We all agree that it’s not the usual method of rising funds for charities but that’s where we thankfully are now. Nero’s concept started years ago as topic of discussion, a what if plan. Slowly we reached the position where we were able to put Nero into action. To actualise the original idea, to commit time and resources. To create law in our image, maybe even reflecting back to a life before and beyond law…
